Google Street View is Legal in Germany

German International Broadcaster, Deutsche Welle has reported that Google Street View is in fact legal in Germany.

Last Tuesday, the Berlin State Supreme Court (“Kammergericht” as it’s known locally) ruled that it is legal to take photographs from street level, rejecting a court case from late last year in which a woman had sued Google, arguing that Google was trying to take unauthorised photos.

The court did not find this woman’s argument convincing, given that the photographs of her, her family and the front of her house were taken from the street and not the sidewalk. As Google blurs faces and license plates and gives Germans the option to conceal their house, the court did not find any violations.

This is the first high-level court ruling regarding Street View since the service was introduced in Germany at the end of last year. This ruling cannot be appealed any further.
